Mr. Tucker is an associate and focuses his practice on employment law including discrimination, civil rights, and Fair Labor Standards Act claims, and complex civil litigation matters. He has significant courtroom experience with numerous successes in the state and federal courts of Virginia and South Carolina, and is licensed to practice in both states.
Mr. Tucker has lectured on the Americans with Disabilities Act, and serves on the Disability Rights Committee of the National Employment Lawyers’ Association. He has worked as a legal editor at American Lawyer Media, Inc., and is an avid soccer player and coach, holding two national coaching licenses.
Representative Engagements:
- In a federal appeal, Mr. Tucker obtained a favorable Fourth Circuit Court ruling for a client establishing the validity of a claim for a company's retaliation against former employees who claim unpaid overtime compensation. The Fair Labor Standards Act, which requires the payment of overtime for all hours worked over 40 per week, contains retaliation protection to "employees" who claim unpaid overtime or minimum wages. Mr. Tucker's case was the first time the U.S. Court of Appeals for the Fourth Circuit has considered the issue of whether former employees are protected from retaliatory acts by their former employers under the overtime law. The Court of Appeals found in favor of Mr. Tucker's client and issued an opinion that provides important protections to workers who file unpaid overtime claims against their former employers.
- Mr. Tucker successfully defended a City Police Department, its Chief of Police, and four officers against claims of violations of federal constitutional rights. The officers were alleged to have engaged in excessive force during an arrest and an unlawful search and seizure, among other constitutional violations. The case was appealed to the Fourth Circuit Court of Appeals, which upheld the lower court’s award of summary judgment in favor of Mr. Tucker’s clients.
- In a Virginia state trial court, Mr. Tucker obtained dismissal of claims of unfair practices against his client, an automobile dealer, after proving that the plaintiff had engaged in intentional discovery abuses.
- Mr. Tucker successfully represented a Virginia state agency against a lawsuit alleging violations of federal constitutional rights by that agency.
- Mr. Tucker has negotiated the favorable resolution of many clients’ claims, including a settlement requiring a local fast food restaurant to make drive-thru windows accessible to customers who are deaf or hard of hearing, and a settlement with a large Virginia municipality requiring its Police Department to change its policies for transporting arrestees who use wheelchairs.
